TERMS OF SERVICE

You agree to and acknowledge the following with respect to any services ordered by you or on your behalf from Ship Luggage, LLC. (Hereinafter “Ship Luggage”)


RATES

Rate quotes generated on the Ship Luggage website, www.shipluggage.com, or by a Ship Luggage customer service representative are based upon the information provided at the time of scheduling shipments. Final rates will be based upon actual weights and dimensions verified during the shipment process.  Final charges may differ than quoted prices due to actual shipment weight and dimensions.


INDEMNITY

You agree to defend, indemnify and hold Ship Luggage and its owners, clients, employees, and agents harmless from all claims, demands, causes of actions, liabilities, damages, costs and expenses, including attorneys’ fees, arising from or related to your acts or omissions in connection with your use of this website or any of Ship Luggage services, including but not limited to, your shipment of any Disallowed Goods as defined below.

 

DISALLOWED GOODS

Ship Luggage will not ship any of the following:

  • Perishables Valuables 
  • Explosives, firearms, ammunition, fireworks, flammables, tear gas, mace, pepper spray etc. 
  • Valuables (jewelry, antiques, china, artwork, etc)
  • Fragile, breakable, or temperature sensitive items 
  • Pets, animals, and Insects 
  • Cash 
  • Hazardous Materials (batteries, oil, gasoline, poisons, infectious substances, etc) 
  • Pressurized containers 
  • Securities and negotiable or confidential papers 
  • Human remains 
  • Alcohol and tobacco products. 
  • Illegal narcotics/drugs

 

Shipments should not contain any items that FedEx classifies as dangerous goods. Many common items are considered dangerous goods, including aerosol sprays, fireworks, lighters, matches, paint and perfume. All shipments must conform to FedEx requirements regarding dangerous goods. To ensure you are in compliance with FedEx dangerous goods requirements, go to www.fedex.com/us/services/options/dangerousgoods, or call 1.800.GoFedEx 1.800.463.3339 and say "dangerous goods". Ship Luggage reserves the right to disallow additional goods in the future.

 

PACKAGING

All customers are required to adequately prepare the contents of their shipments with necessary protective measures to ensure the safety of their shipments. All shipments must be tagged with a secure luggage tag which contains the following information: Name, Address, and Phone Number.

All Items must have a shipping label/airway bill provided by Ship Luggage securely attached to the outside of the Item being shipped and all Items must also include a copy of the shipping label placed inside. Ship Luggage will not be held liable for any shipment delays or lost items due to shipping labels falling off or being removed from the item. Please remove old shipping stickers or labels. Failure to perform these actions may result in a delay of service or a complete loss of your Item and may void any warrantees expressly provided to you below.


CANCELLATIONS and CHANGES

Order cancellations may be made up to 24 hours prior to the scheduled pick-up. Ship Luggage charges a $25.00 fee for cancellations for orders cancelled less than 24 hours prior to the scheduled pick-up.

Changes to pickup dates and times cannot be guaranteed with less than 24 hours of advance notice. In some circumstances, a change fee may be applied. If additional shipping labels need to be sent, a $15.00 fee will be applied. A valid email must be provided if additional shipping labels are needed. There is no charge for changes made to an order with more than 72 hours notice from the scheduled pick-up, so long as the change is not requesting an earlier pickup/departure time.

Changes made after the shipment has been picked up will be subject to a $15 change fee. Ship Luggage does not guarantee any shipment that is changed or re-routed in transit.

In order to change an order in transit, you must call our customer service at 866-455-5032.
 

REFUSAL OF SHIPMENT

Ship Luggage and our agents reserve the right to hold any shipment that exceeds shipment weight booked by 10lbs or more, or may be deemed undeliverable for any reasons stated in our terms and conditions.

 

DECLARED VALUE (Insurance)

Each Item will be automatically insured up to $300.00 (EXCLUDING NORMAL, ORDINARY AND CUSTOMARY WEAR AND TEAR). This insurance covers against major damage and/or loss up to the declared value of the item (excluding luggage), but not any of the costs incurred with replacement of those goods. It does not insure, and Ship Luggage is in no way liable, for any subsequent losses resulting from damaged or lost Items. Ship Luggage is not responsible for delays due to factors beyond Ship Luggage’s control including but not limited to, direct or indirect, acts of God, the unavailability or refusal of a person to accept delivery of the shipment; acts of public authorities acting with actual or apparent authority; acts or omissions of customs or similar authorities; Hazardous Materials packages improperly offered for transport; insufficient information provided by a customer; the application of security regulations imposed by the government, or otherwise applicable to the shipment; riots, strikes or other labor disputes; civil unrest; natural disasters; fire, flood, hurricane, earthquake, disruptions in air or ground transportation networks; incomplete or incorrect address information; and/or failure of delivery equipment. Shipment delays due to these occurrences void all responsibility and liability of Ship Luggage. Ship Luggage is in no way liable or responsible for any losses or damages to Items left unattended while waiting for pickup or property left unattended at the final destination.

 

ADDRESS INFORMATION

Ship Luggage is not responsible for delay or loss of any Item resulting from incorrect, incomplete or invalid address information provided by customer. The customer will be responsible for any charges associated with correcting or changing address information and/or charges associated with returning undeliverable items to the origin address.  Ship Luggage cannot ship to PO Boxes.

 

SIGNATURE RELEASE

Ship Luggage allows luggage to be delivered without a signature release. It is at the discretion of the Ship Luggage agent to determine if a shipment requires a signature or a release at the time of delivery.  If a delivery signature is desired it is the responsibility of the client to indicate as such at the time of booking. Once any order is processed, Ship Luggage is not responsible for any Item released without signature. If a shipment’s destination is a business or hotel, a signature is required for the drop off. Please verify that someone will be present at the business or hotel if that is the intended drop off location. Ship Luggage will not be liable for delayed shipments due to a business being closed, or the missing presence of an individual to sign for the shipment.

 

INTERNATIONAL SHIPMENTS

Notwithstanding anything to the contrary set forth herein, Ship Luggage will not be liable for delays that occur due to customs inspections for international shipments.  If a shipment is delayed in customs, Ship Luggage will make every possible effort to correct the problem, yet customs delays are out of the realm of Ship Luggage’s authority.  At the time of shipping, a Ship Luggage customer service representative will make all preventative measures possible to reduce the complexity of the customs inspection process.  Any fees incurred during the customs inspection process will be passed on to the customer and included in the final billing statement.  You acknowledge that any goods shipped by Ship Luggage are subject to confiscation by U.S. and foreign customs officials and other similar agencies.

 

RIGHT TO INSPECT

Ship Luggage and its agents reserve the right to inspect and open any item shipped by Ship Luggage.

 

LUGGAGE LOCKS

In some cases screeners will have to open your luggage as part of the screening process. If your bag is unlocked agents will simply open and screen the baggage. If bags are locked the screening agent may have to break the locks in order to inspect the bag. ALL INTERNATIONAL SHIPMENTS MUST BE SCREENED AND ALL INTERNATIONAL LUGGAGE MUST REMAIN UNLOCKED.  Ship Luggage is not liable for damage or delays caused to locked bags that must be opened for customs or security purposes.

 

DELAYED SHIPMENTS

In the event that an item is delayed, Ship Luggage will make every effort to locate the Item in a timely manner and deliver the Item to its intended destination. Ship Luggage will be in no way responsible for any losses, personal or business related, arising from the delayed Item.  In the event an Item shipped does not arrive on or before the scheduled delivery date (EXCLUDING DELAYS CAUSED BY FACTORS PREVIOUSLY MENTIONED), Ship Luggage will provide full reimbursement for the “shipping costs” of the item.  All other reimbursements or expenditures must be approved in advance by Ship Luggage and will vary on a case-by-case basis, not to exceed $200 per item, per day, with a maximum reimbursement of $500.00 per item.  Ship Luggage will not be obligated to refund any charges for any of the following reasons:

  • Shipment was delayed, held, or re-routed due the request or actions of the user as defined in our terms and conditions of our website.
  • The shipment delivery was refused by recipient or if there was no recipient present for shipments requiring delivery signature.
  • The shipment was delayed due to an incorrect address.
  • The shipment was delayed due to Customs clearance.
  • Delivery or Pick up location is considered outside primary service areas.

 

Claims for shipments that are delayed or otherwise suffer a loss must be submitted by calling our customer service department at 1-866-455-5032 within 7 days of the scheduled delivery date.

 

WARRANTY AND LIABILITY DISCLAIMER

EXCEPT FOR THE EXPRESS WARRANTIES MADE TO YOU UNDER THE HEADING ABOVE ENTITLED “WARRANTEES”, ALL INFORMATION CONTAINED ON THIS WEBSITE AND ANY AND ALL SERVICES PROVIDED TO YOU BY SHIP LUGGAGE ARE PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND. SHIP LUGGAGE, ITS AFFILIATES AND/OR THEIR RESPECTIVE SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THE INFORMATION ON THIS WEBSITE AND ANY SERVICES PROVIDED TO YOU BY SHIP LUGGAGE, ITS EMPLOYEES, AGENTS, AFFILIATES OR SUPPLIERS, INCLUDING, BUT NOT LIMITED TO ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NONINFRINGEMENT.

THE SHIPPING AND TRANSPORTATION COMPANIES PROVIDING SERVICES FOR AND ON BEHALF OF SHIP LUGGAGE ARE INDEPENDENT CONTRACTORS AND NOT AGENTS OR EMPLOYEES OF SHIP LUGGAGE OR ITS AFFILIATES. SHIP LUGGAGE AND ITS AFFILIATES ARE NOT LIABLE FOR THE ACTS, ERRORS, OMISSIONS, REPRESENTATIONS, WARRANTIES, BREACHES OR NEGLIGENCE OF ANY SUCH SHIPPING OR TRANSPORTATION COMPANIES OR FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR EXPENSES RESULTING THEREFROM. SHIP LUGGAGE AND ITS AFFILIATES HAVE NO LIABILITY AND WILL MAKE NO REFUND IN THE EVENT OF ANY DELAY, CANCELLATION, FORCE MAJEURE OR OTHER CAUSES BEYOND THEIR DIRECT CONTROL, AND HAVE NO RESPONSIBILITY FOR ANY ADDITIONAL EXPENSE, OMISSIONS, DELAYS, OR ACTS OF ANY GOVERNMENT OR AUTHORITY.

IN NO EVENT SHALL SHIP LUGGAGE, ITS AFFILIATES, AND/OR THEIR RESPECTIVE SUPPLIERS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF, OR IN ANY WAY CONNECTED WITH, THE USE OF THIS WEB SITE, OR FOR ANY SERVICES OBTAINED THROUGH THIS WEB SITE, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF SHIP LUGGAGE, ITS AFFILIATES, AND/OR THEIR RESPECTIVE SUPPLIERS HAVE BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. IN NO EVENT SHALL SHIP LUGGAGE, ITS AFFILIATES, AND/OR THEIR RESPECTIVE SUPPLIERS BE LIABLE FOR ANY DIRECT DAMAGES IN EXCESS OF THE LESSER OF THE FEES PAID BY YOU TO SHIP LUGGAGE DURING THE ONE MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR $100.00.

 

Ship Luggage specifically disclaims all warranties with respect to this web site or your use thereof. All information on the web site, including but not limited to graphics, text and links to other sites, is provided “as is” and “as available” and may be changed without prior notice. We do not warrant the content, quality, condition, accuracy, adequacy or completeness of this information. Other than as required by applicable consumer protection law or insurance law, if any, in no event will Ship Luggage of Florida be liable for errors or omissions in this information or for any losses or damages, direct, indirect, incidental, special or consequential resulting from your use or misuse of, or reliance on, any such information. The information is provided without warranty of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement and freedom from computer viruses or similar disabling devices. You are responsible for evaluating the accuracy, completeness or usefulness of any information, advice or other content available on this web site.

Ship Luggage of Florida expressly disclaims any liability, whether in contract, tort, strict liability or otherwise, for any direct, indirect, special, incidental or consequential damages, losses or expenses arising in connection with your use of or inability to use this site or any other web site linked to this site, or in connection with any failure of performance, error, omission, interruption, virus, defect, or delay in operation or transmission, even if we are aware.
